The following claims have damaged the reputation of the BMW driver and hence whoever started any of the claims below might be liable for defamation if the BMW driver decide to sue and the onus is on the claimant to produce evidence to prove what he/she has claimed :

1) the BMW driver is a scammer who has used the same trick to cheat petrol on other occasion(s). (the claimant has to provide the exact time and petrol station location of the occasion in which he saw the BMW driver used the same trick and the petrol station must have a record of the event and/or has the petrol station attendant there to be a witness).

2) the BMW driver lied that he had already decided to sell his car before he went to the petrol station to pump $10 fuel. (the claimant has to prove that the BMW driver only decided to sell the car after the incident had circulated in social media). The onus is not on the BMW driver to prove that he already intended to sell his car before he went to the petrol station. In any case, his claim of pumping only $10 fuel supports his intention to sell his car after that. The onus is on the person who claimed that the BMW driver only decided to sell his car after the incident had happened. Even if the BMW driver went to run some errands during the day before he delivered his car to the car dealer, it is not sufficient evidence in Court that he only decided to sell his car after the incident.

3) the BMW driver forced or demanded the petrol station attendant to pay for the petrol in excess of $10. (i.e. vs the version that the petrol station attendant said, in the heat of anger during the argument with the BMW driver and petrol station cashier) that he would foot the bill and stormed off.
sounds dubious....
