So seems like they want it to go under? Not sure how all these payouts work. I will vote no if the return is so low and does not seem fair.

I was just wondering to myself, what if these proposed terms were just a facade and the true intention is to force liquidation? Can someone analyse who will stand to gain the most in the event of a liquidation? Which party? How much?

Interestingly, in my opinion, I feel there seems to be a lot of loopholes in this whole thing right from the start. Is the police investigating for possibility of fraudulent activities or misrepresentation?

75% is a pretty high threshold, it may not be easy to clear for the perp holders, to me i can only recover $10k, vote yes or no doesnt have much difference to me, so i will just go with the majority. If there is a chance to revise the offer by vetoing, of course it will be good

Salim said they wont raise the offer so that means secured or unsecured MTN holder have to sacrifice for the perps, which i doubt so.

I have long written this off so tbh i'm not too bothered with how much they give back. I'm just not pleased that there would be small number of shares in the CDP which would be such an eyesore and does not spark joy.

it's a combination of the two

(3AB) The conditions referred to in subsection (3AA) are as follows:
(a) unless the Court orders otherwise, a majority in number of —
(i) the creditors or class of creditors;

(ii) the members or class of members; or
(iii) the holders of units of shares or class of holders of units of shares,
present and voting either in person or by proxy at the meeting or the adjourned meeting agrees to the compromise or arrangement;

(b) the majority in number referred to, or such number as the Court may order, under paragraph (a) represents three-fourths in value of —
(i) the creditors or class of creditors;

(ii) the members or class of members; or
(iii) the holders of units of shares or class of holders of units of shares,
present and voting either in person or by proxy at the meeting or the adjourned meeting, as the case may be; and

(c) the compromise or arrangement is approved by order of the Court.
