its not international law but a diplomatic rule conferred through UN resolution voted by its members.The last I checked, UN still say that Taiwan is a part of China.

Technically, if you are not in the UN, you are not a full fledged nation. Of cos you can call yourself whatever you want. It's just who recognises you as such.
