Just wondering, because I believe I have a case of wrongful dismissal and forced resignation / Involuntary resignation.
I have a audio recording of the conversation of the final discussion between the employer and employee. Where the exacted quoted words are:
"Boss: I don't accept your standard, I think you better go and find another job. Right?
I have to let you go, so what do you want to do?
You want to resign or do you want me to give you a letter?
Reply: mmm... It's up to you
Boss:Then you resign. Better for you than for me to terminate you. Ok you go out and give me the letter, That's it, I've had enough"
1) No prior warning letter was given, there was a performance review just explaining which points were not satisfactory
2) A reply was provided to counter all unsatisfactory points, but no reply afterwards.
The admins report directly to the boss. Even though there are line managers, the admins are responsible for almost everything
The language used in the office is abusive, from calling people incompetent to threats of firing.
Given the rough context above, is there any room for wrongful dismissal claim?
Yes, last month salary was paid.
Is it possible for MOM / TADM to step in and investigate?
EDIT: This isn't about compensation, it's about getting the company investigated for it's employee abuse.
Inside people are willing to testify or speak out if questioned by MOM. But they are too afraid to whistleblow because of job security.
