Thanks God. I just check with my insurance company, the other party finally make report after I write email inform the other party insurance about the accident. I still don't know the details and the how much percentage liability but I very happy already. :)

Can claim 3rd party ok le la.
At least not OD.

End of the day, it seem like we are still in the mercy of this stupid system???
Just hope that there isnt anymore victim of such?...

Yaloh. Now can proceed with 3rd party claim. I have submitted all the photos.
I spoke to a lot of people and they said can't do anything unless the other party make report. If the other party don't make report, the case will stuck for 3rd party claim and the repair of car will not proceed.

Only then will they be able to investigate the accident to determine if their policyholder was at fault in the accident and to what extent they were responsible for it.

Well lets put it this way, this stupid regulation(to me~us) is unfair for consumers(to the victim who is claiming 3rd party).

But 'reasonable' to the insurance company as in 'who is paying the bill(repair)'?

We are claiming 3rd party and so to say the other party's insurance company is paying the bill. But if the other party's company is not even informed, is it fair for any claims to happen?

Eeerrrrr the company will 1st protect their 'rights' for not acknowlegde any claims issue til their customer(the irresponsible driver who caused/involved in an accident) to report the case(accident).

So in short to say, the system protect mainly both insurance companies on who is paying during a 3rd party claim.

And if there is a screw-up(as TS faced), victim own insurance company will suggest an OD claim so victim pay for their own bill...........

This is my understanding thou which of course suck big time for drivers like us.

Put it this way, in sg there is no consumer rights. Law won't change unless some white horses kena.

And most main stream insurance don't engage lawyers to pursue individuals. only those black taxi workshop does that.

Your intellect really speaks much about you. Though I don't know how insurance company works completely but I know atleast there is one dude who does filing of case, a surveyor and a solicitor/lawyer at the very least.

Below is a guideline for claiming 3rd party,the 4th/5th time I'm saying. The SOP is insured will claim OD first then insurance will fight against each other.

But you can skip after reading the 2nd paragraph below because,from your replies,your cheap insurance company is plain lazy or have no budget for a good solicitor/lawyer and aptly satisfy this description : "an insurer will not act on your behalf to file a third party claim."

Therefore, you are encouraged to lodge damage claim under your own policy. After you have been indemnified, your insurer will commence recovery against the other driver’s insurer if it can be proven that the driver is fully liable for the accident. Your insurer will not dock your No Claim Discount at next renewal if recovery is successful.

I'm glad my insurer or the few personnels handling my case closely follows the guideline as per GIA.

Btw, given your seasoned experiences with so many motor insurance company. Can you elaborate your experiences with every one of them?
I mean from your broad experiences with motor insurance I bet you won't be only buying from the 2-3 cheap insurance company throughout right? :o

You cant claim aka the other's party insurance company will not do up your claim.

Ermm...i mean buy insurance from 2-3 company and so luckily have accident under all of them but they are all useless so you ASS(ume) that's how they work and nothing to do with cheap or atas expensive insurance.

Hi I didn't create a nickname out of nothing, I saw post directing at me so I decided to recycle it.

But then, most importantly, do convince me with your broad motor insurance experience over so many years.
I'm just a greenhorn who buys my insurance with AD,now I'm hoping to save some money sourcing for my own.

If you noticed,I have been very chill when he start to make snide remark just because of my odd-one-out statement in this thread and he doesn't believe my insurance company goes the "extra mile" e.g. chase the other party for a response,protect my interest etc. FYI my NCD and premium stays the same even after the 10k OD first then claim from the malaysian insurer.

Then subsequently his 'tv shows' came in, greeted my mum, calling me name:mad:$$. The IRONY that someone who called me low-life does such childish things.

Anyway,I'm glad my talk isn't as cheap as Mister ASS(ume) who literally gave no other options for you to consider. There are people who are actually given similar options to what I encounter

2)Claim OD
3)Your insurance demand from the other party's insurer.




While I understand every case and insurer handles report differently. Of course, there are many others in a position like you were with many loophole problems. That's why your insurer's calibre is important.
The key person in helping you is actually the solicitor/lawyer,also the person filing your case suggesting you the best fuss-free options(imo,your AD personnel failed my expectations).

As to how good is that solicitor/lawyer and person filing the case, let's just conclude that it depends on your luck.

I hope you can,too, advise possible options next time when people you know faced the same scenario.
Misinformation like "other party didn't report=can't claim" or the "rear car kiss front car backside=100% rear car fault" should stop.

The fact that they can't claim means they didn't provide enough info, the solicitor/lawyer is useless(yeah..i link them with cheap insurance) or they are indeed at fault

My AD got official reporting centre and repair workshop all together.
Sadly to say that,it is the advice they gave me.
Will convert from 3rd party to claim my own insurance next week if still no news of the other party reporting. If I die die proceed 3rd party claim, then it will jam there and I can't proceed for repair until the other party report to the insurance. Reporting centre told me got one case already 9 months waiting still pending. :eek:

The AD just wanted to proceed works to repair the car and in order to do so they also wanted to ensure that insurance claim is valid, so waiting a third party claim which may not be successful is risky for them.

By right you shld be able to make OD claim with not at fault, your insurance will process your claim and then make claim against the insurance company of the fault party. All the process is hassle free and the insurance officer who handle your case are the person to follow up with all the necessary works, donkey years already since last claim duno if there is any changes now.

I won't dare say it has dragon and phoenix.
I would like to reiterate that the person filing your case and offering your options is pretty important. It is very unprofessional that he/she would tell you the other person's case is dangling there for 9months. It sounds to me like that person is a greenhorn or just using past examples to apply in your case.
But I still believe AXA is pretty reputable and will gladly assist your 3rd party claim no matter the other party have reported or not.

Bro, when you kana car accident and the fault is clearly that of the opposite party, there will typically be no involvement of your own insurance party other than to be notified by the insured party of the accident.

In this instance, what happened in my case was:

1. Got banged from behind on CTE, only 2 of us involved in the accident
2. Reported to my insurer
3. Spoke with my AD (since car very new). They agreed to take up case since it was straightforward and handled the reporting + claim process
4. Started work on my car once they had received OK from the opposite party's insurer + 3rd party assessor had seen the damage

All in all, no work done by my insurer since we were claiming on his insurance. All work done by my AD once they were certain that this is clear cut case. If this is not a clear cut case, the AD / workshop will likely not start repairs on your car first. Your insurer doesn't really play a part in such situations.

Of course, doing a claim on your own insurance is a different story. Then yes, having a good insurer does make a difference.
