A commercial vehicle reversed into my parked stationary car. Driver came out apologise. We exchange contact and he say his insurers will call me the next day.

I filed a report with my insurers within 24 hours and made a third party claim. Its been a week and his insurers have not contacted me.

I called him and ask for a copy of his insurance report, cos my workshop wont start repairs till they see his report. His report states and I cant even understand.

"i parked here at [Location]. I started car for leave this place and was in the process of reverse a car. Suddenly entered from behind and had a contact accident. I never [have] before drive behind anything and when i try reverse also not speeding (just opening brake control)."

His report seems to suggest that I drove into him when my car was parked and stationary. I contacted him and he said he will "Clarify with his insurers". Given the change of statement, I have filed a police report that states that he is making a false insurance report.

Should I proceed with claim "own damage" and repair my car, or wait for the insurers to settle.

My light bracket broke, condenser slight damage, grill, bonnet and front bumper likely need to change. The damages are costly and I am worried about my NCD.

Please help.

Virgin post?

1. Do you have a video of him reversing into you? If not, good luck - you lose.

2. Your workshop can purchase the statement and repot on your behalf, they aren't willing to do so because they know you'll lose due to no video?

3. Either way, seems like it's OD claims since his statement is stronger than yours given that you were 'behind' him and 0 video evidence.

4. External workshop if they advise you to do OD then claim back, means they have 0 confidence, and/or your workshop is actually the authorised distro for your car, which they normally only do OD then claw back.

In short, you are 'dead'. You can claim OD and wait for him to claim your insurance.

The reason your workshop refused to purchase his accident report is because they know you lost, they take up the case without OD, they can't retroclaim your OD later. They want you to claim OD now.

forget it la, don't claim OD. small damage only, just leave it to fight and get your car fixed later on.

continue to drive your car.

btw, when your car is parked, I assume it's those roads parallel parking. within lot or no lot? got take image of the scene?

you probably know why you are at the losing end bit here if you are not in a lot, or the lorry is within your lot etc.

No video, no proof, no need to fight, it's as good as 'back kiss front'.
