Which Relevant Govt Bodies Should I Seek - condo water leakage

Hi all,

basically there's leakage in the masterbed room toliet. Had seeked advice from contractor is caused by the unit above us.

The landlord upstair refused to rectify the problem. He blame it on the unit above theirs now.

Understand based on BCA regulation, the unit above is 100% liable for the cost of repair work. But the landlord is refusing to pay for the cost of work.

So in such case, is there any relevant authority that I can seek assistance?

if i not wrong, condo is your own business, you need to get a lawyer to help you. if hdb, they will help to check and likely cost 50 50, with sub, few 100 only . good luck to you! that what staying in hdb still better.

management office will settle. if that fails u need a lawyer. im from estate management industry.

That's the problem with staying in condo. Any problem within the fence that cannot be resolved amicably, will need legal action. The authority will not get involved.

Simply matter like disposing bulky item also need to pay to get rid. Even residents litter the place, nothing can be done.

management office advise legal letter to the landlord.

Management office had issued two warning letters to the landlord.

so the only way is through lawyer and not any govt bodies? e.g BCA?

If the landlord doesn't comply, your only avenue is to seek help from a lawyer.

so if i seek legal advise. will the other party bear the legal fee incur?

Even if you win the case, you will not be awarded the full cost.

If you lose, you need to bear of the defendant's cost, but also not full.

Complain to the BCA.
If no action taken complain to your MP.

Happened to me before. Basically, my unit was leaking into the unit below. The guy below just moved in, took all sorts of pics and wrote a very detailed letter to us (we received it in our mailbox). Like, one A4 page has 2 big photos etc.

My dad took a look at it and called the contractor. It's quite standard procedure, happened in our old condo also, the guy upstairs fixed it for us then. Headache, but no choice, have to fix. All properties go through wear and tear.. (sometimes I think condos are just not built very well really). And when these things happen, we just have to bear the cost. In your case, ur neighbor upstairs shld pay 100%. When you leak into someone else.. opposite.

upper floor bear full cost. if they refuse, then need to go for legal recourse.

It's a private condo and a private matter. No body can help you. Even if there is a precedent case, in fact there was some years back, you still need to take legal action.

For public housing, at least there is HDB, not TC, to intervene and subsidise!!!

I paid 25% of the cost when my toilet ceiling leaked.
