That might be the original intention, but obviously that didn't happen. At least in SG we have the small claims court. Cheap and easy to sue. If one actually wanted to.It doesn't encourage anything except for common sense: if those in the legal profession see that you are on the right side of the law they they can take on your case even if you don't have the financial resources to take on some huge corporation on the other side.
By disallowing this the system is set up to merely ensure that the common folk have no chance against stronger entities. So pretty much like the US, but just in a slightly different packaging.
