Contract Guarantor

Anyone know information regarding signing as a guarantor for a MINDEF contract? What are the liabilities a guarantor have to bear if the serviceman break the contract bond and under what situation would the guarantor be asked to pay the bond?

Anyone know which MINDEF department one can contact if a such situation occur that a family member signed as a guarantor without the rest of the family knowing and the family members objected and want to void it.

Any help appreciated, thanks.

Depends on your contract. My 10 year bond contract bounds my guarantor to being unable to act as a guarantor in his own capacity while my bond still holds true. However, you can switch your guarantor through your contract.

The clauses where your guarantor has to pay is clearly stated in the contract. Unlawful discharge from service and cheating are the common clauses.

Don't think you can void it just because your family objects. He acted in his own capacity and I think any man who can act as a guarantor will know the consequences in being one.

I think as long as the person who signed it is not doing so under duress and is of a sound mind, there's no way to void it without penalty.

Ask the people who draft the contract?

What if the serviceman quit within the contract period?

I’m afraid the family member only know simple English and don’t know how to read English letter but may be persuaded to sign just to help another relative. Anyone know if the signing is done privately or in the presence of a HR personnel who will brief and explain the clauses?

Read the contract?

Then the family member can go to court and sue the relative for fraud?

Why don't you ask the 'family member'

BTW it's MINDEF not MIDEF

Anyway I don't think this forum is a good place to seek legal advice. Why don't visit those free legal aid clinic for help?

Thanks for the advices.

I'm not seeking any legal advice but just to find out some basic info how a guarantor signing would take place so my family can prepare what necessary action should be taken if it does happen.

So you are afraid your family members will be coerced into signing by your relatives without knowing what they are signing for?

Yes, who knows it might not even be a MINDEF contract.

And if it's done privately the guarantor should keep a copy of the contract, copy down the serviceman details, etc. All this we have to take note.

You're not allowed to quit within the contract period stated. There are cases of people requesting for ER (early release) but is subjected to approval.

For my side, the signing will be in the presence of a HR personnel. If its a short term contract like 2 years Instructor tour, I don't think you'll have a guarantor. But if it's for pilot 10 years, the guarantor will be required to attend and all questions will be entertained, in the language suitable for them. If not the one signing the contract can be the translator.
