to sue Intel with anti trust even amd is not around should be not happening since you see how USA dismissed Apple ban from sales while ITC ruled that their infringe Samsung patents.
AMD is not that weak against Intel if the compiler is using the neutral compiler a.k.a open standard/library. most of the games / benchmarks are compiled using ICC....then you know how is the outcome already
