Hi All when i am serving my ICT I have been receiving both ICT (NS Men) pay and full month employment from my employer since i started work with them.

apparently my company has been paying my full month salary and mindef also give me my NSMen allowance.

eg; my gross is 5k/mth:

Usual: Gross 5K; Take home 4K + CPF 1K = Total Take home $4,000

Now 3 weeks ICT: Gross 5K; Take home 4K + CPF 1K + ICT (21days x $72 = $1512) = Total Take home $5,512

Sure, i dun mind taking extra but just wondering if this is one of the ways a NsMan serving his ICT is supposed to be paid. I asked this question a year back and fellow forummers were saying either mindef/coy will ask back from me but apparently not so.

is your $72 per day classified as "Service Pay"? If yes, everything is in order.

the only time when your civilian income will be reduced is when your company files for a Make-Up Pay.

For example, assuming your gross pay of $5k if divided into your daily pay (assume 31 calendar days/mth): 5000 / 31 = 161.29

ICT duration of 21 days: 161.29 x 21 = 3387.09

therefore, your civilian pay for that month should be about 3389.09 including CPF. For your case, your company has claimed that 3387.09 which was given u as part of your usual company salary.

another scenario would be that ICT pay of 3387.09 will be filed under MUP, whereby Mindef will pay you this amount plus your service pay of $72/pay.

this depends on your company's practice.

do not get confused with MUP and Service Pay.

As a guide, remove your Service Pay from your calculation and see if you have any additional amount given to you.

Thus When i remove my service pay from the calculation I did not suffer any loss of income as my coy paid me my full month as usual. (5k, unchanged)

As long as under your NS Pay, there isn't anything pertaining to MUP means your coy gives you your full month salary as usual.

When there isn't a full month salary, means the balance amount plus with an average of 3-months OT will be given to you under MUP.

As i had mentioned, this varies from different companies and OT is one of the consideration for them to decide if they will file a MUP.

For MUP in particular, as it involves an average of 3-months OT, you might earn either a higher or lower income, depending on the average calculated.

It may seem complicated. But since your company does not file any MUP, you need not worry about this. Nevertheless, one can file their own MUP via NS Portal (usually for the self-employed) whereby Mindef will check with your company if you are entitled for MUP. For info.

Actually I'm not concerned with MUP or not, as I am already getting more then I should.

MUP ensures I do not missed out on any loss of income but it seems if my company doesn't file MUP and still pays me full month salary, i will be given the extra NS allowance by Mindef as thou I am unemployed.

in this case what is your concern of inquiry in hwz? as u seems to understand how the payment works?

Liable to company.

But I still cannot understand why your company got a noob to be their finance manager. He/she dunno how to save money for the company. :D

I think as long as you didn't provide any false info that led to this situation, the cockup is on mindef/company's side, don't think you are liable. Maybe they can argue why you kept quiet about it, but I think you could argue you didn't know lol

The question is whether you want to highlight it (to your company and mindef), or keep quiet and let them figure it out at their own timing.

Who's responsible? Depends.

E.g. Maybe your company has indeed claimed back from Mindef, but the cockup is on Mindef side? Someone forgot to update that your employer is in DIRECT scheme? Or maybe your company didn't claim at all, so Mindef assumes you are unemployed and the cockup is on your company side.

Of course, if and when the issue surfaces, Mindef reserves the right to do this:

Regulation 11 of the Enlistment (Loss of Salaries & Wages-Reimbursement) Regulation, 1978:

Any person who gives false or misleading information in respect of make-up pay claims shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both.

NSmen are to note that if there is any overpayment of make-up pay due to whatever reason, MINDEF/SPF/SCDF reserves the right to offset the excess quantum from their future NS payments, which could be in the form of service pay, make-up pay, awards and allowances.

this is just what i need. i tend to believe its the latter. the definition of claw back from mindef is from the perspective of a make up pay but i did not receive any form of make up pay in this instance..

maybe i will find a time to discuss it with my fellow colleague who will serve his ict soon.

either of them have screwed up for me to get this 'excess'. i didnt really do anything wrong... i even applied for 'NS leave' in my company HR portal.

I guess i will just treat this is a bonus or sorts.
