Hi all need an advice my tenant no pay rent for 3 months, my unit was approved to rent by Hdb 2 years ago, but recently (Dec 2017) Hdb ask me to moved back but I'm busy taking care of my mum at my mum places, from March 2018 my tenant did not pay me, is there anyway way that I'm able to recover my rental?

Just call or msg the tenant (best is go down to the unit). Tell him if he don't pay by today/ tomorrow morning, he need to move out the next day. Don't let it drag the rent for more than 2 weeks.. 3mth is way over the limit.

HDB wanted TS to move back as only allowed till Dec 17. TS has broken the HDB agreement. Tenant only owe March and Apr rental.

If I'm not wrong, his 2yrs approve rental from hdb is up and he did not summit any recent rental online so hdb will usually ask him to move back in.

Anyway the tenant didn't pay the rent so if tenant move out by tomorrow he can move back in. And he don't need to physically move back in, just go police station change NRIC address and he can still live with his mom.

After one nasty experience, my neighbour swear never to rent out one of his rooms. The tenant fail to pay rent accordingly and refused to move out and turn violent. The tenant even called his gangster brother to settle the matter. Subsequently police was called but nothing much could be done.

I sub-letted my flat to a Malaysian. Everything was fine and the lease was renewed for another year. Then suddenly no rent was paid (for 3 months) and my tenant could not be contacted and the flat was vacant .... till she came back from overseas Fortunately, the tenant was honourable to settle all arrears, though I suspect she would lose more in not settling as she got more assets in my flat that I have broken the gate lock and changed.

Which is why I don't understand the hdb rental can approve for 2yrs but the online stupid website can only summit 18 months max.

HDB current rule is min 6m, max 18m.
The tenancy one signs with the tenant is a separate thing but usually it is align to the rules and hence typically a year or 1.5 year lease. It is possible to sign a 3 year tenancy agreement with the tenant but usually one would word it in such a way it is subjected to HDB agreeing to the renewal along the way.

There is a couple of points to take note.

Did the TS not re-apply to sublet the HDB flat again and ensure there is a stamped tenancy agreement? If so, then its an illegal sublet of HDB flat case.

If the above is true, then the tenants who have been staying are staying in it are ILLEGAL and TS will be deemed as negligent. If there's no HDB permission, no stamp duty paid for the tenancy agreement etc for the period Jan 18 till now, then all these are technically illegal and TS is unlikely to have legal/official recourse against the tenant.

U got it. That's why always do thing the legal way. Now TS is at the mercy of the tenant.

yeap... HDB ask TS to move in is basically just saying he cant rent it out anymore, that's all

Tenants can be scary know of one who tell u what u can do with ur living room (common space) and what you can’t ?

Firstly, after Dec 2017 you are not authorized to rent out.

That being said, the house is yours and the tenant not paying rental.

Give them 2 days. Tell them you will lock up your gate at the end of 2 days.

If they don't move out, get a chain a new lock; and lock up the gate.

Definitely it will not be easy (especially if the tenant is local). If will likely become a police case. But you got to what you got to do.
