Used flagship vs New budget phablet

Pros used flagship
- Top specs
- OS update

Cons
- Risk of faulty phone
- No warranty

Seems like budget phablet is the way to go since it cost almost the same as a used phone nowadays.

Which would you choose?

Different people different strokes
If 8/10 here choose used pro tablet, would it change your mind if you're risk averse?
