and that why I said it depends on the judge... if judge feels that you perform fatherly role and if you stop doing it is going to impact the child, gg to the person... especially since there's no custody of the child per se in this topic....
im surprised that this isn't paternity fraud, when the woman knows that the child isnt her husbands. looks like we might need auto opt-in dna testing in the delivery ward.

I agree and it now seems TS is the mummy instead and wants the husband to pay alimony for a child that’s not his own 🙄

Wife A, Husband A = baby must be A or O

Wife B, Husband B = baby must be B or O

Wife O, Husband O = baby must be O

Other combinations, too bad, cannot tell. Need dna test.

If a man discovers that the children are not his biological offspring and files for divorce, the responsibility for child maintenance will still apply if he has accepted them as part of his family (e.g., raised them during the marriage) or if a legal relationship is established (such as adoption). Under the Women’s Charter, Section 70 states that a person who has accepted a child as a member of their family must maintain them, regardless of whether they are biologically related .

As for alimony, it depends on various factors. The court assesses the wife’s financial needs and the husband’s ability to pay. Under Section 69 of the Women’s Charter, the court can order maintenance for the wife based on her contributions to the family and her needs after the divorce . The discovery of non-biological children does not automatically waive the husband’s duty to maintain the wife.

Regarding legal fees, the court typically has discretion in how they are settled. In some cases, the court may order each party to bear their own legal costs, or in contested cases, costs may be awarded to one party based on factors like conduct during litigation or the complexity of the case . There is no strict rule of 50-50; the division of legal fees can vary depending on circumstances.
Better to do DNA test when they were just born.

Exactly... the ruling party has the best chances when not too long ago, MPs suggested amending the women's charter to family charter to reflect its updated role of protecting the family unit rather than women per se...

But this suggestion was thrown out as ruling party MP pointed out women's charter primarily protects women and the title is therefore apt to a T...
family charter makes more sense given what is actually our cornerstone

We were successful in arguing for the Husband for a reduction in relation to the Wife’s share of the matrimonial assets and for the Husband’s obligation to maintain the child to end at the point of the grant of the interim divorce order. The Court further ordered that a refund was to be made to the Husband for the maintenance paid by the Husband to Q.
