My experience is I claim 3rd party and WS appoint a lawyer to process my claim provided its 100% the other party fault but I did not go AD.

Other party having big problem to claim 3rd party insurance, right ?

Did your WS appoint a lawyer on your behalf? The WS lawyer will send the claim to the driver address, if the driver did not inform his insurer, the lawyer will claim directly from the driver. Try to get the lawyer to send the claims directly to the driver and see if he respond.

I went to my AD workshop and i guess they are not like outside workshop who will fight for the customer.

I heard can ask lawyer to claim but only claim back the repair cost and the lawyer fee.

AD normally will ask you claim OD first, if you don't want to claim OD, you may want to try a 3rd party WS stated in your insurance to see what they can do for you.

to update on my case, I did OD claim in the end, with assurance from my insurer that they are confident of recovering the cost of repair from insurer own the car that rear ended me, and my NCD would not be affected. car has been under repair for a week now. Hopefully everything goes smoothly.
