Issues with MKZ - CASE?

In the event if his bankruptcy filing gets through, does this mean any claim from the small claims tribunal against him will fall through?

And on a side note, does anyone want to go down to his place to discuss the matter with him face to face?

As this matter has been caused by him hiding behind his wife's skirt, we have to go down to where his wife's skirt is, no?

How to go down and discuss when the guy is nowhere to be found?

His shop is pretty much gone. Empty shelves now. I'm just lucky I kept my receipts since I didn't 100% trust him when August of last year came around. He started delaying stuff since then, and I started to doubt a little. But I only started to get irritated by him at the end of last year.

I believe this forum is helpful as one of the gathering point for victims like me to discuss how to take action.

Of course everyone wants their money back but even if we cannot get it back we also must take some form action to make sure mike does not get away scot free like this.

I do not know how small claims tribunal can work. This is my opinion as follows, if anyone has better idea please suggest for everyone's benefit:

If he is bankrupt, it probably won't work since legal action cannot be taken against bankrupted people. It is stated on the IPTO website http://app2.ipto.gov.sg/IPTOServices/Indiv...78/Default.aspx

I have put one impt pt as follows:

" 6. Can I file a monetary claim against a debtor who has been made
bankrupt?

A: Once a debtor is declared bankrupt by the Court, you can no longer commence or continue with any legal action against the bankrupt to recover monetary claims that arose before the bankruptcy.

Instead, you can submit a Proof of Debt (Form 23) to the Official Assignee and give an account of your claims against the bankrupts. Debts that are incurred after the date of Bankruptcy Order are not provable (claimable) against the bankrupt's estate. If there is a dispute by the bankrupt over the sum claimed, you will be asked to provide supporting documents. If you are the petitioning creditor, you should also file a Proof of Debt against the bankrupt. Creditors who change their address after filing their Proof of Debt must notify the Official Assignee"

Based on that it is still important to ascertain with the IPTO if Mike has indeed filed for bankruptcy. (which I have sent an email and waiting for reply) If he has, we submit claim to IPTO. If he hasn't we make police report for fraud and make claim at small claims tribunal.

Agreed bro. I believe there are 2 things that we can do for now:

1) Make your case known to the small claims tribunal court,

2) Ensure and verify that mike is indeed filing for bankruptcy. Think of possible actions to take if he does not.

The mods over at SGC are really insensitive. This is the first time where I see that the flamers and trollers of a thread are the mods, not the regular members. Seriously, who appoints these guys?!

good chance SGC is setup by business owners though.

anyway i cant be bothered with their comments though since most of them are brainless anyway.

I was talking about going down to his residential address actually. When's the last time we really saw him anyway?

Its easy to con people from behind a keyboard but not when we're face to face.

Why not post his residential address here and let forumers harass him? I think some form of sick justice should be done since he wasted our time and money....

Call me sick or sadistic, but if I see him suffer I won't gripe about my lost money anymore.

He doesn't seem to mind our plight even though he calls us "friends".

Oh and btw his mkz yahoo group closed down.

just take note that being bankrupt doesn't mean one can run away from debts... still need to pay out debts with his assets if necessary... if all assets are sold, then must wait until he work and save money to pay back...

also do note that small claims tribunal court is not a place to get your money back, but a place where judge will only decide whether you have rights to what you claim... enforcing order of tribunal may cost additional charges.

Hi all, note that filing your claim at the Small Claims Tribunal doesn't mean you'll 100% get your money back. It's just leverage in a sense.

I suggest to wait for IPTO's reply to those that have emailed. If he hasn't filed for bankruptcy as he claims, we can go to the police to report for fraud.

*I've already filed my claim at SCT. While I don't completely intend on getting my money back, I just want to shock him into realising that something is being done against him.

Yeah, going to small claims trib court doesn't guarantee that you'll get your money back either. If the sum owed to you is very minimal (e.g. less than $30 etc), it doesn't make much sense to go through all this hassle sadly.

Updated 1st post on the other forums.

Violence is not an option la..his family how?

I guess patience is the key for now with the fact that we cannot seek for immediate resolution.

Of course violence was never the answer - but if he manages to run away with our money like this then it'd be ridiculous to not have proper lawful justice meted out, wouldn't it?

I think you all should wait for the response from IPTO. If he has filed for bankruptcy, approach IPTO and ask for advice. If he hasn't, go to the police to file for a case of fraud.
