The big payout has happened . It went to Profitable Group. You passed Profitable group money, Profitable Group gave you worthless paper.

This is precisely the issue that Proftable Investors seem to be ignoring. Investors are clinging to some hope that Profitable Group will pay out or refund. Profitable Group have failed to deliver on Boron, on Land Banking Plots and on AAA. Investors have lost money they just have not accepted that the money is gone.

Read this HWZ thread and search the internet. There are no Boron deals. The land banking plots are worthless. There is no big payout on the Philippines.

Hardware Zone has 68,000 viewings on this Profitable Group post and it is the top post in its category. While people have been ripped off hopefully a lot of people have been informed and educated. Well done to Hardware Zone for being public spirited and hosting this thread despite pressure from interested parties.

Seeking your assistance!

hi all,
sincere apologies for my long silence! the past few months were simply crazy for me... i was pre-occupied with various other things: marking my big 3-0, heaps of office work, going for professional training, studying for post-grad exams etc, and was just generally fatigued from this whole festering mess.. but now i'm back and i've some good news to share:

profitable plots has actually refunded me my money! the cheque they issued miraculously cleared, and i'm just relieved that this chapter has FINALLY closed for me...

however, i'm saddened to hear that their admission during my hearing (in chambers) that they do in fact owe me money for 1 year, didn't mark a change in PP's stand towards the rest of their investors :s11:

if there's any other ways i can help, just drop me a msg? what i've told my lawyer is that he has my permission to use anything from my case (affidavits, emails etc) that cld be useful to anyone else in their case

all i ask from u guys:
1. those who know my real name, please respect my request for privacy
2. please refrain from asking me for legal advice, i'm really not able to do that
3. those who happen to have gotten my mobile number, pleeeeease don't call me (especially during office hours), just txt me if it's urgent ok?

apologies for not replying all the PMs either, i haven't logged on in a while :o

Vocallocal, how do i contact you? im new here and from brunei.

PG office raided by CAD this morning! Looks like its pretty serious. Knowing Singapore authorities, they would not make a move until they have sufficient evidence to charge. Looks like we will see another Sunshine Empire story unfold shortly .....

I'm afraid all investors may have now lost their money for good.....

CAD raid

Hi, where do you get this news?

I have invested S$37K on AAA since 2008. Till now, PP has not pay me a single cent. Not even 12.5% interest.

I think my money invested in PP is gone. But I would like to see PP ---- gone too.

Hi,cacwai, where did you get the news on CAD raid ?

PG raided

Hi,cacwai, where did you get the news on CAD raid ?

Couple of independent sources - people who work within the vicinty of PG office and witness the boxes of documents/records lined outside PG office waiting to be carted off by CAD.

Anyone else able to verify and validate the info?

Profitable Group Raided by CAD. Is it true ?

people who work within the vicinty of Profitable Group office witness boxes of documents/records lined outside Profitable Group office waiting to be carted off by CAD.

How do we know its CAD? Maybe Profitable Group are shutting down? Perhaps Profitable Group are moving records to another country? Profitable Group should die a painful death as soon as possible and I really hope the CAD are investigating with the full force of the law behind them. But it would be good if someone can verify this. Dont want to give Profitable Group a gram of credibility by having untrue stuff posted here.

I am so curious what evidence does the CAD has??

Unless the found out(after sooo long), fraudulent transactions involving Boron.
I hope they make PG refund all the Boron $$$ plus interest. What a bunch of cheats!

Good luck to everyone!

The fact that so much payment has been delayed seems like a good reason for the CAD to investigate.

Suggestion

This is an anonymous post. All you need to know is that I am a person well versed in the law who is sympathetic to your plight. Do not bother replying because this is a one-off. What follows is merely a suggestion. If you choose to follow the suggested course of action, YOU DO SO AT YOUR OWN RISK.

Before using this suggestion, CONFIRM THAT IT CONFORMS WITH THE FACTS OF YOUR OWN CASE. DO NOT LIE TO FIT YOUR CIRCUMSTANCES WITHIN THIS SUGGESTION, AS YOU WILL ONLY HURT YOUR OWN CASE AND JEOPRADISE THE CASES OF OTHER BORON INVESTORS.

This suggestion applies to:-

A. Boron investors, whose claim does not exceed $10,000; and

B. any Boron investor who is willing to limit his claim to $10,000 because you are not willing to foot the potential legal bills of pursuing a larger claim in the Subordinate Courts. Keep in mind that limiting your claim in this way means that you cannot later claim the balance.

A claim less that $10,000 can be brought in the Small Claims Tribunal, where you will not be represented by a lawyer, but neither will Profitable Group, so there should be no worry about legal fees.

Your claim is based on the infringement of the Consumer Protection (Fair Trading) Act. You can find a copy of the relevant statute at statutes.agc.gov.sg

Explain to the judge that your claim is against both Profitable Group (Dubai)("PGD") and Profitable Plots (Singapore)("PP").

Explain that on the face of the contract, PGD owes you money which remains unpaid.

Explain that you are ALSO alleging the tort of conspiracy to commit a wrongful act which has damaged you. The judge should know what you are talking about. The conspiracy in question is between PGD and PP as their agent on record.

Your allegation is that PGD conspired with PP to commit an unfair practice as defined in section 4 of the Consumer Protection (Fair Trading) Act. The unfair practice in question was that they failed to explain to you the significant risk of non-payment involved in the Boron Bonds, namely that even as you were being sold the product, already PGD was defaulting on its obligations to other previous Boron investors. On the contrary, their brochures and advertisements gave the impression that payment was guaranteed.

IMPORTANT. To establish that there was material non-disclosure of the risk, you must show the judge that there other Boron investors who were already being denied payment even before you got on board. This means finding Boron investors whose products defaulted even before you can on board. The more you find the merrier. Get written statements from them confirming their experience, with attachments of their contracts. Ideally, these investors should be willing to come forward to act as your witnesses. Necessarily, this argument and my suggestion does not apply to the earliest defaulting Boron investors.

ALTERNATIVE ARGUMENT. This is a tricky one, and the merits are untested. Tell the Court that buried in a collateral agreement (the purchase form) in the small print is the caution that Profitable Group does not dispense legal or financial advice. Tell the Court that you believe this was not because Profitable Group actually refrains from giving advice. If anything, your statements and the statements of your witnesses should confirm that their employees were all too willing to give (wrong) advice and RECOMMEND the product (important that you use the word "RECOMMEND:). Tell the Court you believe this clause was inserted in spite of knowing that employees do RECOMMEND Boron products and give advice, and that you believe it was inserted purely so that PGD and PP could weasel their way out of the ambit of section 27(2) the Financial Advisors Act, which would otherwise require them in law to conduct a Financial Needs Analysis before selling you the product.

Lastly, because you will want judgment against PP, explain that at the roadshow or whatever, you dealt with PP employees, who must have been acting as agents for PGD. Explain to the Judge that the conspiracy lies in PP helping PGD to sell the Boron bonds to you whilst knowing that simultaneously other Boron investors were being denied payment and/or not being afforded the protection of the Financial Advisors Act. Tell the Court that PGD and PP acted hand-in-hand to perpretrate this unfair practice, and thus have committed the tort of conspiracy to commit a wrongful act.

Good Luck.

Dear all,

One last thing. For maximum effect, get as many investors to file their claims in the Small Claims Tribunal at the same time. The Small Claims Tribunal will likely fix the hearing to be heard collectively. The weight of numbers may sway the Court to believe your side of the story.

Again, good luck.

SCT

This is a generic remark on SCT.

Many memembers already tried SCT. There was only 1 success in the very beginning if I am not wrong and after that SCT was rejecting the cases as an investment product.

Even if the suggestions above are good ones, SCT will get back to us saying many other investors/people brought this issue forward and we have rejected their cases as not pertinent to this court. Boron issue is now well known to SCT and they in a hurry to reject our claims there.

We can all still try but I do not really believe much in the SCT for our Boron case.
