Simba ordered to pay S$700,000 in damages to indoor skydiving operator Altitude Xperience for trespass

f63d722d6117cd91f7a7dac35afc0392f198c8a965db50e866c8d54053b23dcc

Telco-operator Simba has been ordered to pay S$698,594.50 in damages to Altitude Xperience, operator of indoor skydiving experience AltitudeX, for damages caused by using its rooftop space without paying rent. AltitudeX was formerly known as iFly Singapore.

Because of the equipment installed on the rooftop, Altitude Xperience was unable to install air-conditioning, resulting in the company being unable to host events during the day.

The total space occupied by Simba is 4.51 square metres.

Simba, the defendant, argued that the rooftop space it was using fell under the mobile installation space since it was unused, as provided for in the Code of Practice for Info-communication Facilities in Buildings 2018 (Copif).

.

greedy iFly, say they cannot install air-con to host events. The 3 other telcos also have their equipment on the rooftop.

Biased
Simba is really suay recently.

Feels like getting worst.

fast.com test 2.5mbps
Speedtest app 5mbps - can fluctuate to 20+ mbps

Youtube max at 720p, 1080p will lag and keep stopping

4G senior plan, at home sia not even at congested peak hour mrt.

knn greedy sia
if you read the article, i smell some biasness and greed.

iFly rooftop have 3 telco antenna installed no issue. But when Simba come and install, they say must pay for "rent". But the rules say buildings must set aside space for telcom equipment. They sued simba that they lose space to install air conditioning, thus, leading them to lose income. What?

This leads to the main issue simba is facing in reality, many people complaint that Simba is slow, and weak network. It's not because simba don't want to improve, it's these landlords do not want simba to come install unless they pay.

Simba is a small lion cub, imagine if they successfully acquired M1, they become Mufasa. Buildings might allow them to install to fight against Scar (Singtel).

I mean, it's the reality. If you are a building owner, someone famous come and want to work with you, and someone with no name come, which one would you work with?

It is the same for repeater antennas inside buildings and underground mrt stations.

Simba repeaters are lesser than other telco in older buildings.

The telco argued that it could remain there rent-free under Singapore’s telecom facilities code, but Altitude Xperience said the spaces did not qualify.

The Info-communications Media Development Authority had earlier found that the rooftop space was not unused space and did not have to be provided rent-free. Simba’s appeal to the Minister was later dismissed for being filed too late.

Something is not right, SIMBA is not a fly-by-night business. They would have consultants / professionals who understand the teleco rules in Spore. So all these advisors did not inform SIMBA on the legal issues?

Access to rooftop almost always has to be escorted or at least approved by building management.
And they will not allow access if there is no agreement, so what happened there ?

yes. In the first place, why would they allow simba to climb up to roof to install the equipments, when they can straight up reject them access?
