Issues with MKZ - CASE?

wait a minute... if everyone affected persons email or call IPTO, will they entertain each and every of our queries?

Not trying to be a wet blanket here but perhaps those who has already sent email or checked with IPTO can updates the rest of us here so we can then decide on our next course of actions?

I was given a chance to obtain the refunds, but I declined as I wanted the pre-ordered items to come (So give chance with my trust in him)... And I am regretting it every second... Trust misplaced.

same shoes as u man, not regretting though, but learned to trust no one now

I have sent my own email to IPTO as well.

Dear Sir,

I am writing to enquire if the following person or company has filed
for bankruptcy.

Company Name: Mikel'Z
#B2-04B, 211 New Bridge Rd, Singapore 059432

Name: MIKE CHIA YEOW FAH
IC No:SXXXXXX
I have placed several deposits with him amounting to several hundred
dollars since last year and he had suddenly sent a mass email
notifying that he had filed for bankruptcy.

Please kindly advise how I can proceed to make a claim against him or
the company.

I tot his company name now is M.K.Z By MIKEL'Z

not so sure if we shuld post his NRIC here

I don't see anything wrong in posting IC no. I am not flaming or mistakenly accusing anyone. I am a victim. He ran away without accounting for anything. This is a fact.

Hi guys, latest update from what i know so far.

As the business MKZ is terminated and that mike is filing for bankruptcy, CASE will not be able to help us (as expected).
Thus, we will cease the collation of your emails. ( the main purpose was to go to CASE before his announced bankruptcy filing, if you all can remember)

The advice given is to file a case with the small claims tribunal court as an individual. Please read up here on the proceedings that you should take. It is mentioned that this procedure must be done ASAP before mike is declared a bankrupt. I understand that the business profile is also required, this can be purchased from the ACRA website.

zeta will update on his findings shortly.

Hi guys,

I'm back from CASE. As what kurogane posted, the advice given to me by their officer was - to claim from Small Claims Tribual. Since his business is now terminated, they can't mediate any claims on our behalf.

Follow the link that kurogane has posted to find out more about making your claim. do take note that you'd have to purchase his business profile and fill up some form to make your claims.

Good luck, really. He may avoid paying us if he's officially declared a bankrupt.

Has anybody purchased the business profile yet? It makes more sense for 1 person to buy it instead of everybody paying $5 for it individually.

Also, it's stated that "expenses would be incurred in lodging the claim". How much expenses? :s11:

I think you'd have to buy it individually as there's a receipt number on the profile as proof of your purchase. (I know cause I bought it.)

"Expenses for lodging a claim" - from my knowledge, it's between $10 and $20, depending on the size of your claim.

Are you aware that in spite of enforcement proceedings, you may not be able to recover any money? Your decision to commence enforcement proceedings should consider whether the other party has any valuable assets to be seized to satisfy
the sum ordered to be paid. If after issuing a Writ of Seizure and Sale, it is found that the other party has no assets to be seized, you would not be able to recover any money and also stand to lose your execution costs

Lodging a claim at the Small Claims Tribunals does not mean that you will definitely be able to
recover money from the party you are suing as this depends on whether the other party is in a
financial position to pay or whether the other party has assets of sufficient value to be seized
to satisfy the sum ordered to be paid. It also depends on whether you afford the time, effort
and expenses (eg. costs of execution proceedings) required to recover the sum.

What does Mike have left to be seized? Those Rider Mask Collections left behind in his store?

He probably has those uncollected goods in his store as well, and maybe some other stuff that he has but didn't bring to his store. His supposed 'warehouse', probably his own home.

The mods over at SGC are really insensitive. This is the first time where I see that the flamers and trollers of a thread are the mods, not the regular members. Seriously, who appoints these guys?!
